Work Permit Employer Change in Germany: Complete Guide
Switching employers in Germany is not always paperwork-free — EU Blue Card holders must notify the Ausländerbehörde within 12 months, and all work permits must stay tied to qualifying employment.
Overview
Most German work residence permits are granted for qualified employment. When you change employers, switch roles, or lose your job, immigration rules kick in — separate from your employment contract and payroll setup.
| Details | |
|---|---|
| Legal duty | §82 AufenthG — inform Ausländerbehörde of relevant changes |
| EU Blue Card (first 12 months) | Notify within ~2 weeks — authority has 30 days to object |
| EU Blue Card (after 12 months) | Free employer choice — no notification in most cities |
| Skilled worker permits | Notify office — new role must stay qualified employment |
| Job loss | 3 months job search (up to 6 for long-term Blue Card holders) |
This guide covers employer switches while your permit is valid. For first-time work permits, see EU Blue Card or skilled worker visa. For unemployment steps, see ALG I guide.
Who needs to notify the Ausländerbehörde
| Permit type | Employer change rules |
|---|---|
| EU Blue Card — first 12 months | Must notify — 30-day objection window |
| EU Blue Card — after 12 months | Change freely — local card update may still be needed |
| Skilled worker (§18a / §18b) | Notify — BA may re-review qualified employment |
| Employer-specific permit | Often stricter — new employer usually needs approval |
| Student switching to work | New permit application — not a simple notification |
| Opportunity Card → work | Apply for work permit when job offer signed |
Read the Zusatzblatt (supplement sheet) on your Aufenthaltstitel — it states whether employment is tied to one employer or allows changes.
EU Blue Card employer change
First 12 months (§82 Abs. 1 Satz 6 AufenthG)
- Sign your new contract — verify salary meets 2026 Blue Card thresholds (€50,700 / €45,934.20)
- Notify the Ausländerbehörde without undue delay (practice: within two weeks)
- Start working — prior approval is not required in most cases
- Authority has 30 days to object if the new job fails Blue Card rules
- If no objection within 30 days, the change is deemed accepted
Send with notification:
- New Arbeitsvertrag (employment contract)
- Stellenbeschreibung (job description)
- End of old employment (Kündigung or employer letter)
- Erklärung zum Beschäftigungsverhältnis from new employer if BA review is triggered
Failure to notify on time can lead to Blue Card revocation (§52 Abs. 2b AufenthG).
After 12 months
You may change employers without notifying the Ausländerbehörde in most federal states. The new job must still qualify for Blue Card renewal — salary and qualification matching matter at extension time, not only at switch.
Some cities (e.g. Berlin LEA) still recommend updating employer details on file. Check local practice.
Skilled worker and other work permits
For §18a / §18b permits:
- Notify the Ausländerbehörde before or immediately after starting the new role
- Employment must remain qualified — not auxiliary or unskilled work
- Bundesagentur für Arbeit may review conditions again
- If salary or role no longer qualifies, you may receive a different permit type or a time-limited tolerance period
If the new job would qualify for a Blue Card (salary above threshold), ask about upgrading your permit — faster path to permanent residence.
Changing role with the same employer
Notify the office if:
- Salary drops below Blue Card threshold (relevant for renewal and year-one changes)
- Duties no longer match your qualification
- Working hours drop below full-time skilled employment
Internal transfers usually still require notification during the Blue Card first year if conditions change materially.
If you lose your job
Act immediately — waiting risks illegal residence:
| Step | Action |
|---|---|
| 1 | Register as arbeitslos at Agentur für Arbeit same day or next |
| 2 | Inform Ausländerbehörde of termination |
| 3 | Search for qualifying employment within tolerance period |
| 4 | Keep health insurance active |
Job-search tolerance:
| Situation | Typical period |
|---|---|
| Standard work permit termination | 3 months |
| EU Blue Card held ≥ 2 years | Up to 6 months |
| No qualifying job found | Permit may expire — leave or switch route (Opportunity Card if eligible) |
During job search you may claim ALG I if contribution requirements are met — this is generally not treated like Bürgergeld for permit purposes, but always confirm with the Ausländerbehörde.

Many cities accept notifications via online contact forms (Berlin LEA, Munich KVR). Keep copies and delivery confirmation.
Step-by-step timeline
Sign new contract
Verify role and salary meet permit rules before resigning
Notify Ausländerbehörde
Within ~2 weeks of job change (Blue Card year 1)
Authority review window
Up to 30 days — objection possible on Blue Card year 1
Start new job
Usually immediately after notification — unless office suspends
Updated permit card (if required)
Some cities reissue eAT with new employer — weeks to months
Before you resign
- Compare new salary with salary calculator and Blue Card thresholds
- Confirm role matches degree or vocational qualification
- Ask HR for Stellenbeschreibung in German if possible
- If unsure, book a consultation at Ausländerbehörde before signing
After you sign
- Submit employer change notification with documents
- Continue old job until contract end date unless negotiated otherwise
- Update Steuer-ID and payroll with new employer — same tax ID
- If processing delays permit update, you may receive a Fiktionsbescheinigung — check §81 type before travel
At permit renewal
The Ausländerbehörde checks current employment against permit type. A job that worked mid-year may fail renewal if salary fell or role changed.
Switching permit type (not just employer)
| From | To | Process |
|---|---|---|
| Student | Employed | Apply for work permit before student permit expires |
| Opportunity Card | Blue Card / skilled worker | Application with job contract |
| Blue Card | Skilled worker (lower salary) | Downgrade application at Ausländerbehörde |
| Work | Permanent residence | Apply when route requirements met |
These are new applications, not §82 notifications.
Common mistakes
- Starting work before notifying (Blue Card year 1) — fine if notification follows quickly, but delays risk revocation.
- Assuming any job keeps Blue Card valid — Fast-food or unskilled roles fail qualification matching.
- Ignoring 30-day objection window — Do not make irreversible moves if authority suspended the change.
- Missing unemployment registration — Three-month clock starts at termination.
- Letting insurance lapse between jobs — Gap can block renewal.
- Not updating employer on eAT — Some employers ask for permit copy — request updated card if city reissues.
- Confusing notification with approval on skilled worker routes — BA can block unqualified roles.

Frequently asked questions
Do I need permission to change employers on an EU Blue Card?
No prior approval is required, but within the first 12 months of Blue Card employment you must notify the Ausländerbehörde without undue delay (within about two weeks). The authority has 30 days to object if the new job does not meet Blue Card requirements. After 12 months, you may change employers freely without notification in most cities — though local practice on updating your card varies.
What if my new salary is below the EU Blue Card threshold?
The Ausländerbehörde may reject the job change or switch you to a skilled worker permit under §18b if the role still qualifies. If the job is not skilled employment, your permit may be shortened or revoked. Use our EU Blue Card and skilled worker guides to compare routes before signing.
How long can I stay unemployed on a work permit?
After contract termination, you typically have three months to find qualifying employment — up to six months if you have held an EU Blue Card for at least two years. Register with the Agentur für Arbeit immediately and inform the Ausländerbehörde. See our unemployment guide for ALG I steps.
What documents do I send for an employer change?
Usually: new employment contract, detailed job description (Stellenbeschreibung), termination or end confirmation from the old employer, updated payslip proof if requested, and the employer declaration form (Erklärung zum Beschäftigungsverhältnis) for BA review on some routes. Check your Ausländerbehörde portal for the exact list.
Can I switch from work permit to a different permit type?
Yes — for example from student to work, or from Opportunity Card to EU Blue Card — by applying at the Ausländerbehörde before your current permit expires. This is a change of purpose, not a simple employer notification. Book early and bring all documents for the new category.
Does changing employers reset the clock for permanent residence?
No — qualifying employment periods generally continue toward settlement permit timelines as long as you remain on an eligible permit without long gaps. Extended unemployment or permit downgrades can affect your PR application — keep pension and insurance continuous.
