Fiktionsbescheinigung in Germany: Complete Guide for Expats
The Fiktionsbescheinigung legalises your stay while a permit application is pending — but travel and work rights depend on which §81 paragraph is checked on the form.
Overview
A Fiktionsbescheinigung (fiction certificate) is a paper document from the Ausländerbehörde that proves your stay in Germany is legal while your residence permit application is being processed. It is issued under §81 AufenthG when you apply to extend an existing permit or receive your first Aufenthaltstitel after entry.
| Details | |
|---|---|
| Legal basis | §81 Aufenthaltsgesetz |
| Issued by | Local Ausländerbehörde |
| Purpose | Bridge gap until new Aufenthaltstitel is ready |
| Typical validity | 3–6 months (renewable) |
| Is it a travel document? | No — carry passport + expired permit card too |
Critical: The certificate looks the same for everyone, but rights differ depending on which paragraph of §81 is marked on the form. Work and travel rules are not universal — read your specific paper before acting.
For renewal steps, see visa extension. For permit types, see German visa types.
When you get one
| Situation | Typical fiction type |
|---|---|
| Extending a valid or recently expired Aufenthaltstitel | Often §81 Abs. 4 (continuation) |
| First permit after national D-visa entry (Blue Card, student, etc.) | Often §81 Abs. 3 (stricter) |
| Changing permit type (e.g. student → work) | Case-by-case — ask explicitly |
| Permit expired but timely application filed | Fiction may legalise stay from appointment date |
| No application filed | Illegal stay — fiction does not help |
Processing a new card often takes 4–12 weeks. In cities like Berlin or Munich, total waits can exceed three months — the Fiktionsbescheinigung covers the gap.
The three types (what matters on the form)
German offices mark one of these on the certificate. Check the box on your document — do not rely on general advice alone.
§81 Abs. 4 — Fortgeltungsfiktion (continued validity)
Best case for expats. Your previous Aufenthaltstitel is treated as still valid with the same rights until a decision is made.
| Right | Usually allowed? |
|---|---|
| Stay in Germany | Yes |
| Work / freelance | Yes — same scope as old permit |
| Travel abroad + re-enter Germany | Yes — if certificate still valid on return |
| Schengen travel | Generally yes — carry passport, expired card, and fiction paper |
This is the type you want when renewing an EU Blue Card, work permit, or student permit.
§81 Abs. 3 Satz 1 — Erlaubnisfiktion (permission to stay)
Your stay in Germany is tolerated while the application is pending, but rights are limited.
| Right | Usually allowed? |
|---|---|
| Stay in Germany | Yes — while application pending |
| Work | No — unless certificate says Erwerbstätigkeit gestattet |
| Travel + re-entry | Risky / often no — stamp may say Gilt nicht zur Auslandsreise |
Common for first applications after entering on a national visa without a plastic card yet.
§81 Abs. 3 Satz 2 — Duldungsfiktion (deferred enforcement)
The strictest form — often when an application was late or status is uncertain.
| Right | Usually allowed? |
|---|---|
| Stay in Germany | Tolerated only |
| Work | No |
| Travel | No — re-entry generally impossible |
If you receive this type, speak to a migration lawyer immediately.
Comparison table
| Type | Legal reference | Work | Travel & re-entry |
|---|---|---|---|
| Continued validity | §81 Abs. 4 | Same as before | Allowed if cert. valid |
| Permission to stay | §81 Abs. 3 Satz 1 | Usually no | Usually not |
| Tolerated stay | §81 Abs. 3 Satz 2 | No | No |
What to bring to your appointment

At the appointment, explicitly ask which fiction type you receive and whether Erwerbstätigkeit gestattet applies. Request written confirmation if you need to travel or change employers.
Step-by-step process
Permit nearing expiry
Book Ausländerbehörde 6–8 weeks ahead
Submit extension / new permit application
At appointment — while still legally resident if possible
Fiktionsbescheinigung issued
Same day — check which §81 paragraph applies
Certificate validity
Usually 3–6 months — renew if processing continues
New Aufenthaltstitel ready
Pickup or post — 4–12 weeks after appointment
1. Book before expiry
Follow our visa extension guide: apply 6–8 weeks before your Aufenthaltstitel expires. Save appointment confirmation — it does not replace the fiction paper but helps prove you acted in time.
2. Submit your application at the Ausländerbehörde
Bring all renewal documents — contract, health insurance, Meldebescheinigung, passport, photos, fees.
3. Receive the Fiktionsbescheinigung
Issued same day in most cities if processing will continue past your permit expiry. Verify:
- Which §81 paragraph is checked
- Expiry date on the certificate
- Any stamps restricting travel (Gilt nicht zur Auslandsreise)
- Whether employment is permitted
4. Carry the right documents daily
Until your new card arrives, carry:
- Passport
- Expired Aufenthaltstitel (plastic card or sticker)
- Fiktionsbescheinigung (original paper)
The green paper alone is not valid ID at borders.
5. Renew or collect your new permit
If processing exceeds the fiction validity, renew the certificate before it expires — especially before travel. Pick up or receive by post your new eAT (electronic residence permit) when ready.
Travel rules (read carefully)
Safe travel checklist (§81 Abs. 4 only):
- Fiction certificate valid on date of return
- Passport valid
- Expired permit card in hand
- Return before certificate expiry if possible
Do not travel if you hold §81 Abs. 3 without explicit written permission — airlines and border officers can deny boarding. Consulates abroad cannot renew German residence fiction.
For business trips or home visits during permit renewal, get written confirmation from your Ausländerbehörde.
Work and employment
| Scenario | Guidance |
|---|---|
| Same employer, §81 Abs. 4 | Continue working as before |
| Job change during fiction | Notify Ausländerbehörde — new employment may need explicit permission on certificate |
| §81 Abs. 3, no work stamp | Do not work — illegal employment risks permit refusal |
| Lost job during fiction | Register with Agentur für Arbeit; inform Ausländerbehörde immediately |
Costs
| Item | Typical amount |
|---|---|
| Fiktionsbescheinigung alone | Often €0 — included in extension application fee |
| Extension application | €96–113 depending on permit type |
| Renewal of fiction paper | Usually no separate fee |
Common mistakes
- Travelling on §81 Abs. 3 — Cannot re-enter; stranded outside Germany.
- Working without permission — Certificate must allow Erwerbstätigkeit.
- Throwing away expired card — Needed with fiction paper at borders.
- Assuming appointment email = legal status — Fiction or valid permit required.
- Letting fiction paper expire before travel — Renew at Ausländerbehörde first.
- Starting new job without notifying office — Especially within first 12 months on Blue Card.
- Ignoring type on form — All advice depends on the checked §81 paragraph.

Frequently asked questions
What is a Fiktionsbescheinigung?
It is a temporary certificate from the Ausländerbehörde proving your stay is legal while your residence permit application is being processed. It does not replace a passport or residence card for border crossings on its own — always carry your passport and expired permit card together with the paper.
Can I travel outside Germany with a Fiktionsbescheinigung?
Only if it is issued under §81 paragraph 4 (Fortgeltungsfiktion — continued validity of your previous permit). With §81 paragraph 3 types, re-entry to Germany is generally not guaranteed and travel abroad is risky. Ask the Ausländerbehörde before booking flights and check the checked box on your certificate.
Can I work with a Fiktionsbescheinigung?
With §81 paragraph 4, you keep the same work rights as your previous Aufenthaltstitel. With §81 paragraph 3, employment is usually not permitted unless the certificate explicitly states Erwerbstätigkeit gestattet (employment permitted). Never start a new job without written confirmation from the Ausländerbehörde.
How long is a Fiktionsbescheinigung valid?
Typically three to six months, and it can be renewed if processing continues. The legal fiction may continue even after the paper expires if your application is still pending — but renew the certificate before travelling if expiry is near.
What if my permit expires before my Ausländerbehörde appointment?
Book the earliest appointment and keep confirmation. At the appointment, request a Fiktionsbescheinigung to legalise the gap. Staying in Germany with no appointment and no valid permit is illegal — appointment confirmation alone is not enough until fiction is granted.
Do I need a Fiktionsbescheinigung for my first Aufenthaltstitel?
Often yes if processing takes longer than your entry visa. First-time applications after arrival may receive §81 paragraph 3 fiction rather than paragraph 4 — stricter on travel. Collecting your first card after EU Blue Card or student visa entry is a common scenario.
